These terms and conditions (“Credo Health Terms”) shall be applicable to all diabetes related medical and diagnostic services and/or other ancillary services and/or any other services provided on the Credo Health website, m-web and mobile application (collectively referred to as “Platform”), operated by Credo Health Services Private Limited and/or facilitated through its partner company or companies (also known as “Credo Health” or “Us” or “Our” or “We”) and availed by users (also known as “You” or “Your” or “User”) of the Platform.
This document is an electronic record in terms of Information Technology Act 2000, and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. Please read the Credo Health Terms and Credo Health Privacy Policy (collectively referred to as “Agreement”) carefully before availing Medical Services or accessing or using the Platform. Your use of the Platform and the Medical Services shall signify Your irrevocable acceptance of the Agreement

Please note that any and all information, material or details available on the Platform (except such information sought from a Registered Medical Practitioner) is not a substitute for medical care or advice and none of this information should be used for the purpose of self-diagnosis or treatment. Please seek and rely on medical advice sought from a Registered Medical Practitioner
ii. The details of the registered medical practitioners of Credo Health and/or third-party registered medical practitioners (collectively “Registered Medical Practitioners”), available on the Platform is not a recommendation or endorsement by Credo Health regarding the qualifications or the services provided by such practitioners and appointments booked by You to avail the Medical Services. This has been made by You voluntarily, at Your option.
You hereby provide Your consent to Credo Health to share (where required) the Medical Records and/or obtain/store Medical Records which includes the details recorded by the Registered Medical Practitioners in the course of the consultations and reports generated by Credo Health, its Registered Medical Practitioners engaged by Us, and upload such medical and sensitive information on the Platform. Additionally, You acknowledge that nurses, paramedical staff, diagnostic service providers, other persons employed or engaged by Credo Health for providing You services may also have access to the Medical Records and accordingly provide Your consent to share the Medical Records with such persons. You hereby provide Your consent to share/notify Your Medical Records (as monitored by Credo Health) with You through SMS / other messaging services including but not limited to, WhatsApp messaging services. All Medical Records shall be stored, used and disclosed only in the manner stipulated under the Credo Health Privacy Policy. You can choose to withdraw Your consent in the manner provided under the Credo Health Privacy Policy.
The Platform allows You to create a sub-account for family members and friends (“Secondary User”) also. The information and details regarding the Secondary User including their personal and sensitive information (such as name, age, date of birth, contact number, email address) and appointments on their behalf for Medical Services offered by Credo Health can be maintained by You on the account provided that You have been duly authorised by such Secondary User in this regard. For avoidance of doubt, You hereby unequivocally and unconditionally confirm that (i) the personal information added by You on the account in relation to each Secondary User has been added pursuant to the consent obtained by You from such Secondary User, or in case of persons who do not have the capacity contract under law, in Your capacity as the parent or legal guardian of such Secondary User, and (ii) the Secondary User has consented to You receiving the reports in relation to such Secondary User, and to Credo Health storing, possessing, sharing, using and accessing such information, reports and Medical Records as per the terms hereof. Once You provide the contact number of the Secondary User, the Secondary User will receive notification/SMS from Us with respect to appointments, Medical Records, etc.

Credo Health, as part of its core philosophy, under its diabetes packages will strive for reversing Your diabetes once You opt for Medical Services. “Diabetes Reversal” for the purpose of Credo Health Terms shall mean maintaining an HbA1c below 6.5%, with the elimination of glycaemic control (diabetic) medications (except for Metformin which is used by individuals for reasons other than blood sugar control). To achieve reversal, You will have to strictly adhere to the Credo Health’s programme and Health Package over a period of 12 months or more depending upon the situation (on a case-to-case basis) and recommendation from the Registered Medical Practitioner. However, We do not guarantee any cure of diabetes since diabetes depends on multiple factors including but not limited to, behavioural and lifestyle changes and has all possibilities of recurrence.
Credo Health aims at improving Your general metabolic health and for achieving this objective, You may choose to participate in Experiments with the purpose of exploring and switching to healthier alternatives in relation to eating, sleep schedule, etc. and monitor Your glucose levels. Please note that participating in such Experiments is optional and can be discontinued at any point in time during the subsistence of Your Credo Health package. Credo Health does not promote/endorse consumption of any of the food items included in the Experiments, nor does it promote/ endorse any particular form of lifestyle. Results of Experiments may vary from person to person and are dependent on a number of factors other than Your food intake. Credo Health does not guarantee accuracy in results of Experiments and same shall not be construed as medical advice in any form, whatsoever.
Please note that We provide the above services through Our Platform. To ensure that We provide premium service to You, We may sometimes tie-up with other third-party hospitals and clinics for their expertise. You hereby consent to Us sharing Your Medical Records with such third-party hospitals or clinics, nursing homes or similar institutions without requiring any further action. Please note that We shall not be responsible for any pilferage of information or illegal dissemination of Your Medical Records by such third-party. If requested, We will provide You with the details of the third-party with whom We have shared Your Medical Records if You send an email to info@credo.health.
Please note that appointments for physical consultations and tele-consultations may not be advisable in cases of emergency or critical conditions since We cannot guarantee appointments. We shall not be responsible for any inconvenience or loss caused to You as a result of delay in medical evaluation or treatment.
Please further note that devices that may be provided as part of Medical Services are provided by third-party sellers licensed to sell said devices and Your usage of the said devices is governed by its own set of terms and conditions. Please read the terms and conditions for such devices prior to usage. Your usage of the same may be construed as Your consent to such terms and conditions.
You may cancel the appointments for the Medical Services prior to the appointment. The cancellation shall be governed as per the timelines mentioned on the Platform. You shall not be entitled to any refunds if appointments are cancelled after the period as specified in the timeline provided on the Platform.
You may reschedule the appointments for the Medical Services prior to the appointment, subject to availability of a time slot/registered medical practitioner for appointment. Timelines mentioned on the Platform shall govern such rescheduling of appointments.
You expressly understand and agree that, to the maximum extent permitted by applicable law:
Credo Health shall provide all Services and shall ensure that all Services are provided, professionally and in compliance with applicable law. If despite such care and due diligence the reports generated by Credo Health or any partner of Credo Health or any part thereof is found to be incorrect or incomplete, the total liability of Credo Health shall be limited to carrying out a retest of the sample provided or carrying out another test using such method which can provide reasonably error free results, free of cost. The selection of the alternative test shall be made by Credo Health at its sole discretion. All medico legal liability attributable to Registered Medical Practitioner engaged by Us shall be the sole responsibility of such Registered Medical Practitioner.
You hereby acknowledge that under no circumstances shall Credo Health or its employees, consultants, agents or officers be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from Your use of or inability to use the Services or to access the Medical Records or Your use of any ancillary Services provided on the Platform.
You further agree and confirm that Credo Health shall not be responsible, in any manner whatsoever, for any delay in performance or failure to meet its obligations under this Credo Health Terms which may be caused, directly or indirectly, due to:
You agree that any violation by You of these Credo Health Terms will constitute an unlawful and unfair business practice, and will cause irreparable harm to Us and/or Our third-party partners, as the case may be, for which monetary damages would be inadequate, and You consent to Credo Health obtaining any injunctive or equitable relief that they deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies that the Credo Health and/or its third-party partners may have at law or in equity. If Credo Health and/or third-party partner takes any legal action against You as a result of Your violation of these Credo Health Terms, they will be entitled to recover from You, and You agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief that may be granted.

In the event You come across any abuse or violation of these Credo Health Terms or if You become aware of any objectionable content on the Platform or if You wish to report a grievance regarding Platform, please report the same to the following e-mail id: info@credo.health.
You hereby expressly agree to receive communications by way of SMS/WhatsApp and/or e-mails from Credo Health, and other third parties relating to the Platform and Services provided through the Platform. You can unsubscribe/ opt-out from receiving communications through SMS/WhatsApp and/or e-mail anytime by e-mailing to info@credo.health.
Notice: All notices from Credo Health will be served by email to Your registered email address or by general notification on the Platform. Any notice provided to Credo Health pursuant to the Credo Health Terms should be sent to info@credo.health with subject line – Attention: TERMS OF USE.
Assignment: You cannot assign or otherwise transfer the Credo Health Terms, or any rights granted hereunder to any third-party. Credo Health’s rights under the Credo Health Terms are freely transferable by Credo Health to any third-party without the requirement of seeking Your consent.
Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Credo Health Terms, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Credo Health Terms shall continue in full force and effect.
Waiver: Any failure by Credo Health to enforce or exercise any provision of the Credo Health Terms, or any related right, shall not constitute a waiver by the Credo Health of that provision or right.
17.1 Notification. We respect the rights of third parties in their intellectual property. If You have an intellectual property rights-related complaint about material posted on the Platform, You may contact Us at the following address: No. 92/1A, Konappana Agrahara, Electronic City Post, Bengaluru, Karnataka, India – 560100 E-mail: info@credo.health. Any notice alleging that materials hosted by or distributed through the Service infringe intellectual property rights must include the following information:
(a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other right being infringed;
(b) a description of the copyright-protected work or other intellectual property right that You claim has been infringed;
(c) a description of the material that You claim is infringing and where it is located on the Platform;
(d) Your address, telephone number, and email address;
(e) a statement by You that You have a good-faith belief that the use of those materials on the Service is not authorized by the copyright owner, its agent, or the law; and
(f) a statement by You that the above information in Your notice is accurate and that, under penalty of perjury, You are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
17.2 Repeat Violations. Credo Health will promptly terminate without notice the accounts of users that are determined by Credo Health to be a “repeat violator”. A repeat violator is a User who has been notified of infringing activity or has had User Content removed from the Platform at least twice.
17.3 Nothing contained in this clause may be perceived as a limitation to the ability of Credo Health to suspend User accounts for User content violations in the first instance.
The Platform may also allow You to display, use, include or make available content, data, information, applications or materials from third parties, including, without limitation, content, data, information, applications or materials (“Third-Party Materials”). By requesting an import of Third-Party Materials, You agree that We may import that information from the applicable third-party service. Credo Health may also provide tools through the Platform that enable You to export information, including User Content, to third-party services. By requesting an export of information, including User Content, to third-party services, You agree that We may export that information to the applicable third-party service. Third-party services are not under Our control, and We are not responsible for any third-party service’s use of information You provide or information You export or disclose. When You use any Third-Party Materials or third-party services, You do so at Your own risk and You understand and agree that You are solely responsible for reading, understanding, and complying with any terms of use and/or privacy policies that apply to such third parties’ terms of use and privacy policy. The Platform may also contain links to third-party websites. Linked websites are not under our control, and We are not responsible for their content. Credo Health is not responsible or liable for the availability, reliability, content, functions, accuracy, legality, appropriateness, services, materials or any other aspect of such Third-Party Materials or third-party websites that link to or from the Service or are otherwise referenced on the Platform. Credo Health also does not accept any responsibility for technical failures or for unauthorized access of User transmissions by any third parties. If You choose to use Third-Party Materials and third-party websites together with the Platform, such use is entirely at Your discretion and risk.
If You violate any provision of these Terms, Your permission from to use the Platform will terminate automatically. In addition, Credo Health may in its sole discretion terminate Your User account on the Platform or suspend or terminate Your access to the Platform at any time, with or without notice. We also reserve the right to modify or discontinue the Platform, any features thereof, or any Services at any time without notice to you. We will have no liability whatsoever on account of any change to the Platform or any suspension or termination of Your access to or use of the Platform. You may terminate Your account at any time by contacting customer service at info@credo.health. If You terminate Your account, You remain obligated to pay all outstanding fees, if any, relating to Your use of the Platform incurred prior to termination.
Your use of the Platform is subject to all additional terms, policies, rules, or guidelines applicable to the Platform or certain features of the Platform that We may post on or link to from the Service (the “Additional Terms”), such as end-user license agreements for any downloadable software applications, or rules that are applicable to a particular feature or content on the Platform. All Additional Terms are incorporated by this reference into, and made a part of, these Terms.
We reserve the right, at Our sole discretion, to change or update these Terms from time to time. Please check these Terms periodically for changes or updates. Immaterial modifications are effective upon publication. If a change or update to these Terms materially modifies Your rights or obligations, We will update the “last updated” date at the top of this page and make reasonable efforts to notify You that material changes have been made to the Terms. Your continued use of the Platform after any such change or update constitutes Your acceptance of the new Terms. If You do not agree to any of these Terms or any future Terms, do not use or access (or continue to access) the Platform.
The Platform is owned and operated by Credo Health Services Pvt Ltd. The visual interfaces, trademarks, graphics, names, logos, marks, content (other than User Content), design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Service (“Credo Health Materials”) are the intellectual property of Credo Health Services Pvt Ltd and are protected by intellectual property and other laws. All Credo Health Materials contained in the Platform and all trademarks, service marks, patents, copyrights and any and all other intellectual property rights and proprietary material related thereto are, and will remain, the exclusive property of Credo Health Services Pvt Ltd or Our third-party licensors. Except as expressly authorized by Credo Health Services Pvt Ltd. You may not copy, republish, post, display, translate, transmit, reproduce, distribute or otherwise make use of the Credo Health Materials. The information displayed on the Platform is for Your personal use only. Credo Health Services Pvt Ltd reserves all rights to the Credo Health Materials not granted expressly in these Terms. If at any time, You make any submissions, including but not limited to suggestions, feature ideas, bug reports, comments, You assign all rights in these submissions to us. Credo Health Services Pvt Ltd shall be entitled to use such submissions for any purpose, whatsoever, without compensation to the maker. In any event, such submissions are not and will not be treated as confidential and We will not be liable for any disclosure of submissions.
We act as a technology platform to connect You with Medical Practitioners who may be available to provide You with certain non-emergency medical care, however Credo Health is not itself a healthcare provider, and the Medical Practitioners are solely responsible for providing You with any medical care and treatment You receive in connection with Your use of the Service. We do not manage, control or interfere with the practice of medicine by the Medical Practitioners, each of whom is responsible for the professional medical services he or she provides. The information provided by Credo Health as part of the Credo Health Materials and through the Platform is for general informational purposes only. None of the Credo Health Materials should be considered medical advice or an endorsement, representation or warranty that any particular medication or treatment is safe, appropriate, or effective for you.
You agree that You will be responsible for Your use of the Platform, and You agree to defend and indemnify Credo Health from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (a) Your access to, use of, or alleged use of, the Platform; (b) Your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms or any applicable law or regulation; (c) Your violation of any third-party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (d) any dispute or issue between You and any Third-Party. We reserve the right, at Our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You (without limiting Your indemnification obligations with respect to that matter), and in that case, You agree to cooperate with Our defense of that claim.
Credo Health is required to comply with applicable healthcare privacy and security laws and maintain safeguards to protect the security of Your health information. Additionally, the information You provide to Your Medical Practitioner during a medical consultation is legally confidential, except for certain legal exceptions as more fully described in Our Notice of Privacy Practices. We devote considerable effort toward ensuring that Your personal information is secure. Information regarding Our use of health and other personal information is provided in Our Privacy Policy and Notice of Privacy Practices, currently available on Our website. As part of providing You the Services, We will communicate to You via email and text message. Email and text messages are not secure methods of communication and Credo Health cannot ensure the security or confidentiality of messages sent by email and/or text message. Information, including personal health information, transmitted by email or text message is not encrypted and could be read by a Third-Party. If You would prefer not to exchange personal health information via email or text message, please notify Us at info@credo.health.
While the platform facilitates access to certain medical practitioners for non-emergency medical care, Credo Health is not a healthcare provider and cannot and does not diagnose or treat your health conditions. Credo Health provides no endorsement, representation or warranty that any particular medication or treatment used by the medical practitioners is or will be safe, effective or appropriate for you. Do not use the platform or services for medical emergencies. If you think you may have a medical emergency, call the contact number for emergency services in your region immediately. The platform and all Credo Health materials and all content available through the service are provided “as is” and on an “as available” basis, without warranty or condition of any kind, either express or implied. To the extent allowed by law, Credo Health disclaims all warranties of any kind, whether express or implied, relating to the platform and all Credo Health materials and content available through the platform, including: (a) any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; and (b) any warranty arising out of course of dealing, usage, or trade. Credo Health do not warrant that the platform or any portion of the service, or any Credo Health materials or content offered through the platform, will be uninterrupted, secure, or free of errors, viruses, or other harmful components, and do not warrant that any of those issues will be corrected. You assume all risk for any damage that may result from your access to, use or misuse of, or inability to use the platform, your dealings with any medical practitioner or other user, and any Credo Health materials or all content available through the platform. You understand and agree that you use the platform, and access, download, or otherwise obtain Credo Health materials or content through the platform and any associated sites or platform, at your own discretion and risk, and that you are solely responsible for any damage to your property (including your computer system or mobile device used in connection with the platform), or the loss of data that results from the use of the platform or the download or use of that material or content. Some jurisdictions may prohibit a disclaimer of warranties and you may have other rights that vary from jurisdiction to jurisdiction. To the extent that we may not disclaim any implied warranty, the scope and duration of such warranty will be the minimum permitted by law.
In no event will Credo Health be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the platform or any Credo Health materials or content on the platform, including but not limited to any medical advice or treatment by the medical practitioner, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Credo Health has been informed of the possibility of damage.
In the absence of our gross negligence or wilful misconduct, you agree that the aggregate liability of Credo Health to you, for all claims arising out of, or relating to, the use of or any inability to use, any portion of the platform or otherwise under these terms, whether in contract, tort, or otherwise, is limited to the greater of: (a) the amount Credo Health has received for your access to and use of the platform in the twelve months prior to the claim; or (b) ten thousand rupees (Rs 10,000/-).
Credo Health shall in no event be liable to you (or to any third-party claiming under or through the you) for any indirect, special, incidental, consequential or exemplary damages arising from your use of, or inability to use the platform. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses, even if Credo Health knew or should have known of the possibility of such damages, because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the extent permitted by law.
Each provision of these terms that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under these terms between you and Credo Health. This allocation is an essential element of the basis of the bargain between us. Each of these provisions is severable and independent of all other provisions of these terms. The limitations in this section 18 will apply even if any limited remedy fails of its essential purpose.
You alone are responsible for Your communications, interactions, agreements, representations, promises or any other involvement with other Users. Credo Health reserves the right, but has no obligation, to monitor disagreements between You and other Users. If You have a dispute with one or more Users, You irrevocably and forever release Credo Health from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
These Credo Health Terms shall be governed by the laws of India. In the event of any dispute between the Parties in relation to these Terms, the courts in Bengaluru shall have exclusive jurisdiction.
